1. Scope

These terms apply to all orders placed in the online shop gusto39.com. Your contractual partner is:

Deviating terms of the buyer apply only if we agree to them in writing.

2. Businesses only

We sell exclusively to businesses (hospitality, retail, trade). Businesses based in the EU need a valid VAT ID; businesses based outside the EU (e.g. in Switzerland) can also order without a VAT ID. By placing an order, you confirm that you are acting as a business. Consumer protection rules, in particular the right of withdrawal, therefore do not apply.

You store your company details and, if based in the EU, your VAT ID in your customer account. We check the VAT ID automatically via the EU's VIES system. If your company details change, please update them in your customer account.

3. Customer account and prices

Prices are only visible after logging in. Product prices, shipping costs and minimum order value depend on the delivery country. The prices shown in the cart when the order is submitted apply. All prices are net plus statutory VAT, where applicable. For deliveries within the EU to businesses with a valid VAT ID outside Austria, the reverse-charge procedure applies.

4. Conclusion of contract

The presentation of products in the shop is not a binding offer. By submitting your order, you make a binding offer. The contract is concluded when we confirm your order by email.

Pallets are pre-orders. A contract for a pallet is only concluded when we confirm the pre-order by email.

If we cannot deliver all or part of an order, we will inform you and refund any amounts already paid to the original payment method.

5. Minimum order value

The minimum order value depends on the delivery country. You can find the values for each country in our shipping terms. There is no minimum order value for collections from our Nuremberg warehouse.

6. Payment

You pay at checkout when placing your order. Payments are processed by Shopify Payments and Mollie. Options include, for example, credit card, Apple Pay, Google Pay, Klarna and local payment methods such as EPS. You will receive the invoice by email.

7. Delivery and collection

We deliver with the freight forwarder Kühne + Nagel in a refrigerated truck at a constant −18 °C to the kerbside of the specified delivery address. You name your preferred day, at the earliest 24 hours after ordering. We confirm it by email. Delivery times are guidelines, not a binding commitment.

You can also collect your order from our Nuremberg warehouse. We will arrange the collection time with you after you order.

8. Transfer of risk

Risk passes to you as soon as the goods are handed over at the delivery address. For collection, it passes on handover at our Nuremberg warehouse.

9. Retention of title

The goods remain our property until paid in full.

10. Changes and cancellation

You can change or cancel your order by phone or email until the goods leave our warehouse. This also applies to pallet pre-orders. Amounts already paid are refunded to the original payment method. We do not take back frozen goods once they have left the warehouse.

11. Inspection, complaints and warranty

On handover, check the delivery for visible damage, quantity and correct items. Report transport damage, wrong items or missing quantities no later than 7 days after receipt. Report defects that only become apparent later immediately after discovery, and no later than 30 days after receipt. Send complaints to [email protected].

If a complaint is justified, we will deliver a replacement or refund the amount, as agreed with you. The process is described on our page “Returns and complaints”. Otherwise, statutory warranty rights apply.

12. Liability

We are liable without limitation for intent and gross negligence and for personal injury. We are not liable for slight negligence. Claims under the Product Liability Act remain unaffected.

13. Use of the shop

Content, images and texts of the shop are protected by copyright. You may use them only to place orders with us. Automated scraping of the shop is not permitted.

14. Data protection

How we process your data is explained in our privacy policy.

15. Applicable law and place of jurisdiction

Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction is the court with subject-matter jurisdiction for Zell am See.

16. Final provisions

If any provision of these terms is invalid, the remaining provisions remain valid. We may change these terms. The version published in the shop when your order is submitted applies to your order.
